2. Purpose of the website
The website provides information about CanvasPlus and enables customers to enquire about or purchase personalised canvas products, pre-designed products, fan-inspired artwork and related services. Product-specific descriptions, prices, delivery charges and ordering steps appear on the relevant product, cart, checkout or quotation pages.
3. CanvasPlus intellectual property
Unless otherwise stated, the CanvasPlus name and branding, original website text, original artwork, layout, graphics, photographs, product mock-ups and other original website material are owned by or licensed to CanvasPlus and are protected by applicable law.
A user may view the website and retain an order record for personal, non-commercial purposes. No material may be copied, republished, modified, sold, scraped at unreasonable volume, framed, distributed or commercially exploited without prior written permission, except to the extent allowed by law.
4. Fan-inspired content and third-party rights
Names, logos, characters, titles, artworks, photographs, team identifiers and other third-party material remain the property of their respective rights holders. CanvasPlus respects those rights and will only reproduce protected material where it believes it has permission, a licence or another lawful basis.
Unless expressly identified as official or licensed, a fan-inspired product is not represented as sponsored, approved or endorsed by the relevant rights holder. References to third-party subject matter are descriptive only. A fan-art label, attribution or disclaimer does not by itself create permission to reproduce or sell protected material.
CanvasPlus may remove material, request proof of rights, suspend a listing, refuse production, or cancel and refund an unperformed order if an intellectual-property concern arises. Removal or review does not constitute an admission of liability.
5. Customer-submitted material
A person who submits an image, design, logo, text or other material confirms that they own it or have the permissions and consents required for CanvasPlus to process and reproduce it for the requested order. This includes consent from identifiable people and appropriate authority for material involving children. CanvasPlus may refuse unlawful, infringing, defamatory, hateful, abusive or exploitative content.
The limited licence granted for an order is described in the Terms of Service. CanvasPlus does not acquire ownership of customer content, and marketing use requires separate consent.
6. Reporting an intellectual-property concern
A rights holder or authorised representative may send a notice to support@canvasplus.co.za. To support a fair and prompt review, include:
· the reporting party’s full name, contact details and authority to act;
· a clear identification of the protected work or right;
· the exact CanvasPlus page, product or material concerned, preferably with a URL or screenshot;
· an explanation and supporting evidence showing why the use is alleged to be unauthorised; and
· a good-faith confirmation that the information supplied is accurate.
CanvasPlus may request additional information, temporarily restrict the material, communicate with the affected supplier or customer, and take action reasonably appropriate under the circumstances and applicable law.
7. Accuracy of information
CanvasPlus takes reasonable steps to keep website information accurate and current, but typographical errors, outdated information or technical inaccuracies may occur. Product availability, specifications, prices and promotions may change before an order is accepted. An accepted order will not be materially changed without a lawful basis or the customer’s agreement.
Website content is general commercial information and is not legal, financial or other professional advice.
8. External links and third-party services
The website may link to or rely on third-party services, including payment, ecommerce, hosting, social media and courier services. A link does not necessarily imply endorsement. CanvasPlus does not control independent third-party content or availability, although it remains responsible for its own duties under an order and applicable law.
9. Website availability and security
CanvasPlus uses reasonable measures to operate and protect the website, but cannot guarantee continuous, error-free or completely secure access. A user is responsible for maintaining the security of their device, account credentials and communications and must not attempt to disrupt, probe or gain unauthorised access to the website.
10. Limitation of liability and consumer rights
To the fullest extent permitted by law, CanvasPlus is not liable for indirect or consequential loss arising solely from reliance on general website information or from an interruption outside its reasonable control. Any lawful limitation is subject to the Terms of Service and the circumstances of the claim.
Nothing in this Legal Notice excludes liability or a right that may not lawfully be excluded, including protected rights under the Consumer Protection Act and the Electronic Communications and Transactions Act, or liability for fraud, prohibited gross negligence, unsafe or defective goods, personal injury or death where applicable.
11. Electronic communications and records
By communicating electronically with CanvasPlus, a user consents to receive order-related notices and records electronically where lawful. The customer should retain order confirmations and policy copies. A request for an accessible transaction record may be sent to the support email address while that record remains reasonably available.
12. Governing law and complaints
This website and Legal Notice are governed by South African law. Questions and complaints should first be sent to CanvasPlus for attempted resolution. Nothing prevents a consumer from approaching a competent court, consumer ombud, the National Consumer Commission or another forum available under law.
13. Updates
CanvasPlus may update this Legal Notice prospectively by publishing a revised version and a new last-updated date. The legal terms applying to a completed purchase remain those governing the order when concluded, unless a later change is required by law or agreed with the customer.
